The agreement
These terms govern your use of www.luunlabs.com (the “site”), which is operated by Luun Labs LLC (“Luun Labs”, “we”, “us”). By using the site you agree to them. If you do not, please do not use the site.
They apply to the site only. Work we do for a client is governed by a separate written agreement, and where the two differ, that agreement controls.
What the site is for
The site describes our services, shows work we have done, and gives you a way to get in touch. It is informational. Nothing on it is an offer, a quote, or professional advice, and the descriptions of services and past projects do not promise a particular outcome for yours.
Sending an enquiry through the project form or by email does not create a contract, and does not oblige either of us to anything. A client relationship begins only when Luun Labs and the client enter into a separate written agreement, whether a proposal, a statement of work, or another agreement expressly accepted by both parties, on paper or electronically.
Using the site
You are welcome to browse the site and to share links to any page of it. You agree not to:
- use the site for anything unlawful, or in a way that could harm someone else;
- submit enquiries that are false, misleading, abusive, or sent in bulk;
- probe, scan, or attempt to breach the site, the form endpoint, or the systems behind them;
- bypass or attempt to bypass rate limits, authentication, or other technical restrictions;
- interfere with the site’s operation, including by automated requests or scraping at scale;
- impersonate us, or suggest we endorse something we have not.
We may block access to the site, or decline to respond to an enquiry, if these are breached.
What you send us
When you send an enquiry, you confirm the details are accurate and that you are entitled to share them. We use them to reply and to discuss your project, as described in our privacy policy.
Please do not put confidential material in the form. We take reasonable care with what you send us, but sending it through the site does not create a confidential, fiduciary, or similar relationship; only a written agreement does that. Suggestions or feedback about the site itself may be used by us without any obligation to you.
Intellectual property
The site’s design, code, text, images, video, and the Luun Labs name and logo belong to us or are used with permission, and are protected by copyright and trademark law. The names and artwork of our apps and games are our marks. Apple and the App Store are trademarks of Apple Inc.; other marks belong to their owners.
Client work shown on the site belongs to those clients and appears with their permission. It is there to illustrate what we do, not for reuse.
You may quote short passages with attribution and a link, and you may share links to the site freely. Anything more, such as reproducing pages, images, or code, needs our written permission first.
Other sites and services
The site links to our clients’ live sites, our game studio, LinkedIn, the App Store, and the sources behind the statistics we cite. We do not control those sites and are not responsible for their content, availability, or terms. A link is not an endorsement, and each site’s own terms and privacy policy apply once you are there.
Statistics and claims
Figures on the site about consumer behavior and web performance come from third-party research, and each one links to its source. We reproduce them in good faith but do not guarantee their accuracy or that they will hold for your business. Results described in case studies are specific to those clients.
Apps and games
Our apps and games are distributed through their own storefronts, and your use of them is governed by the terms of those storefronts and by any terms or privacy policy shown with the product. For example, Interval Habit Timer has its own privacy policy and support page. These terms cover the site, not those products.
No warranties
The site is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties about it, express or implied, including that it will be accurate, uninterrupted, error-free, or free of harmful components. We may change, suspend, or withdraw any part of the site at any time without notice.
Limitation of liability
To the fullest extent the law allows, Luun Labs will not be liable for any indirect, incidental, special, consequential, or punitive loss arising from your use of the site or your reliance on anything on it, including lost profits, lost data, or business interruption, even if we were told it was possible.
Our total liability for any claim relating to the site is limited to the greater of one hundred US dollars (US$100) or the amount you paid Luun Labs specifically for use of the site in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Governing law
These terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict of law rules. Any dispute about the site will be brought in the state and federal courts located in Nebraska, and you agree to their jurisdiction. If you are a consumer, nothing here takes away protections you have under the law of the place you live.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. Changes apply from the date they are posted, not to anything that happened before, and continuing to use the site after a change means you accept them.
General
If any part of these terms is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of the business. Together with the privacy policy, these terms are the whole agreement between us about the site.
